WAIVER, INDEMNIFICATION, AND RELEASE OF LIABILITY AGREEMENT PLEASE READ CAREFULLY – THIS AGREEMENT AFFECTS IMPORTANT LEGAL RIGHTS In consideration of being permitted to participate in any way in activities, programs, practices, competitions, camps, clinics, and related events, including travel to and from such activities, conducted by Valley Sports Foundation and CBC Basketball (collectively referred to as the “Organizations”), I, for myself and, if applicable, on behalf of my minor child, and for my personal representatives, heirs, executors, next of kin, and assigns, hereby agree as follows: 1. Acknowledgment of Sport and Rules I acknowledge that I am familiar with the sport of basketball and understand the rules governing the sport and the importance of following those rules, as well as the instructions of coaches and staff. 2. Inspection of Facilities and Equipment I agree that prior to participation, I will inspect the facilities and equipment to be used. If I believe anything is unsafe, I will immediately notify a coach or supervisor and refuse to participate until the condition is corrected. 3. Assumption of Risk I understand and acknowledge that basketball is a contact sport and involves inherent risks, including but not limited to serious bodily injury, permanent disability, paralysis, illness, or death. These risks may result from my own actions or inactions, the actions or inactions of others, the condition of the facilities or equipment, or the negligence of the Organizations or other participants. I further acknowledge that there may be additional risks that are not known or reasonably foreseeable at this time. 4. Voluntary Assumption of Responsibility With full knowledge of these risks, I voluntarily assume all risks of injury, illness, death, or property damage arising from participation. I accept full personal responsibility for any damages or losses that may result. I understand that any insurance maintained by the Organizations may not provide coverage for my personal injuries or losses, and I acknowledge that I am responsible for maintaining my own medical and accident insurance coverage. 5. Release and Waiver of Liability To the fullest extent permitted by California law, I release, waive, discharge, and covenant not to sue: •Andre Chevalier •CBC Basketball •Valley Sports Foundation •Sierra Canyon •All affiliated clubs and organizations •Their respective administrators, directors, officers, agents, coaches, employees, volunteers, event officials, medical personnel •Other participants and their parents/guardians •Sponsors, advertisers, and •Owners, lessors, or lessees of premises used for activities (collectively referred to as the “Releasees”) from any and all claims, demands, causes of action, losses, or damages arising out of or related to participation, including those caused in whole or in part by the negligence of the Releasees. 6. Indemnification I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, liabilities, damages, costs, or expenses, including reasonable attorney’s fees, arising out of or related to my (or my minor child’s) participation in any activity conducted by the Organizations. 7. Minor Participants If signing on behalf of a minor under 18 years of age, I acknowledge that I am the parent or legal guardian and that I consent to the minor’s participation. I understand that by signing this Agreement, I am giving up on behalf of the minor the same rights I would be giving up if signing on my own behalf. I agree to explain the risks and responsibilities outlined in this Agreement to the minor participant. 8. Governing Law and Venue This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any dispute arising out of or related to this Agreement shall be brought exclusively in a court of competent jurisdiction located in the State of California. 9. Termination This Agreement may be terminated only by: 1.Ceasing participation in all activities of Valley Sports Foundation and CBC Basketball; and 2.Providing written notice of termination to Valley Sports Foundation. Medical Authorization I authorize the directors, coaches, and representatives of Valley Sports Foundation and CBC Basketball to seek emergency medical treatment for me (or my minor child) if I cannot be contacted. I agree to be financially responsible for any medical treatment provided.
